It's always puzzled me as to why DC Comics, who now own the Shazam Captain Marvel, haven't sued Marvel Comics for publishing an admitted rip-off of their character. Plagiarism, pure and simple.
I think it was Marvel that sued DC for the right to use Captain Marvel back in the 60's, both parties use the character captain marvel but only Marvel gets to use that as the title for its comic- MJ Southcoast base
What I read was that when DC licensed Captain Marvel from Fawcett in the early '70s, Marvel threatened to sue them, which is why, after a few issues, they changed the cover subtitle from The Original Captain Marvel to The World's Mightiest Mortal. However, Marvelman was a copy of Captain Marvel, 'created' to fill the vacancy when Fawcett agreed to cease publishing CM after their lawsuit with DC. That being the case, as DC now owns Shazam, theoretically they have the right to sue Marvel who now own Marvelman/Miracleman as he's a copy of CM/Shazam.
